PER CURIAM.
VanBuskirk was convicted by a jury in the District Court in 1961 on an indictment charging him with transporting in interstate commerce approximately eight thousand dollars ($8,000.) which he had obtained by fraud, trick, scheme or artifice, in violation of Title 18 U.S.C. § 2314. He was represented by counsel at the trial. He filed a motion for judgment of acquittal or for a new trial, alleging, among other things, an attempt by the prosecuting witness to communicate with a juror by exhibiting to him a Masonic emblem. The juror reported this incident to counsel for VanBuskirk.
The District Judge conducted a hearing at which the testimony of the juror, a deputy United States Marshal, and of another witness was introduced. The District Judge found from the evidence that the alleged attempt to communicate did not prejudice or bias the juror. He denied the motion, relying on Ryan v. Upon the factual record in this case we hold that both matters rested within the sound discretion of the trial judge. We ruled on the direct appeal that there was no abuse of discretion. We are of the same opinion now. In our judgment there has been no denial of VanBuskirk’s constitutional rights.
