ALLRIGHT OF MIAMI, INC., APPELLANT,
v.
CLARA OESTERLE AND RALPH OESTERLE, APPELLEE

Fla. 3d DCA | 1987-05-26
No. 86-820
Before SCHWARTZ, C.J., and DANIEL S. PEARSON and JORGENSON, JJ.
507 So. 2d 771 Florida District Court of Appeal, Third District (1987)

Opinion of the Court
PER CURIAM.

PER CURIAM.

We reverse the order of the trial court denying the motion of Allright of Miami, Inc., for a new trial. We agree with All-right that the trial court erred in admitting evidence of Oesterle’s reputation for truthfulness in the absence of any attack upon her character. General Tel. Co. v. Wallace, 417 So. 2d 1022 (Fla.2d DCA 1982); § 90.609(2), Fla.Stat. (1985). Accordingly, we reverse and remand for a new trial.

Reversed and remanded.
