This matter is before the Court on consideration of the report and recommendation of Christopher P. Tuite, United States Magistrate Judge, entered on October 24, 2024. (Doc. 3). (4) Plaintiff is directed to file an amended complaint and motion to proceed without costs on or before December 20, 2024. Failure to file an amended
