THIS CAUSE comes before the Court upon United States Magistrate Judge Shaniek Mills Maynard's Report & Recommendation that this case be dismissed (the “Report”) [ECF No. 5]. ORDERED AND ADJUDGED as follows:

1. The Report and Recommendation [ECF No. 5] is ACCEPTED. 2. Plaintiff's Notice of Removal [ECF No. 1] is DISMISSED. 3. Defendant's Motion to Proceed In Forma Pauperis [ECF No. 3] is DENIED.

4. The Clerk is directed to CLOSE this case.

5. All pending Motions are DENIED as MOOT.
