JAMES LAVANCE CASON,
v.
THE STATE OF FLORIDA,

Fla. 3d DCA | 2020-07-29
No. 20-0280
Florida District Court of Appeal, Third District (2020)

Opinion of the Court
Miller

PER CURIAM.

James L. Cason appeals an order granting his Rule 3.800(a) motion. The order on appeal is not an appealable order pursuant to Florida Rule of Appellate Procedure 9.140(b)(1)(D). This is because a defendant’s right to appeal applies only to an order denying or partially denying post-conviction relief. See Brown v. State, 227 So. 3d 215, 216 (Fla. 3d DCA 2017); Dearriba v. State, 225 So. 3d 932, 934 (Fla. 3d DCA 2017). Because we lack jurisdiction, we dismiss this appeal.

Appeal dismissed.
