Opinion of the Court

KOVACHEVICH, District Judge.

This cause is before the Court on Plaintiffs’ motion to remand, filed January 30, 1990, and response, filed March 14, 1990.

Statutes conferring diversity and removal jurisdiction should be strictly construed.

Owen Equipment and Erection Co. v. Kroger,

437 U.S. 365, 98 S.Ct. 2396, 57 L.Ed.2d 274 (1978). As to removal statutes they are strictly construed because: 1) the exercise of removal is in derogation of state sovereignty; 2) jurisdictional allegations for removal are extremely simple for any lawyer to draft; 3) a liberal construction would promote uncertainty as to a court’s jurisdiction in marginal cases; and 4) 28 U.S.C. § 1446(b) is a statute of repose designed not to unduly delay trials.

ORDERED that the Clerk of the Court remand this cause to the Circuit Court of the Twentieth Judicial Circuit, in and for Lee County, Florida.
