United States v. Gibbs, 662 F.2d 728 (11th Cir. 1981)…counts of bankruptcy fraud in violation of 18 U.S.C.A. § 152. The jury acquitted Gibbs on three counts but found him guilty on the fourth. This Court affirmed the conviction on appeal. United States v. Gibbs, 594 F. 2d 125 (5th Cir.), cert. denied, 444 U.S. 854, 100 S.Ct. 110, 62 L.Ed.2d 71 (1979). Gibbs subsequently filed a petition to vacate his sentence pursuant to 28 U.S. C.A. § 2255 and a motion for a new trial.
