William S. Burkhart appealed from a lower court decision regarding temporary alimony, suit money, and counsel fees in a marital dispute with Leonora Forney Burkhart. The Florida Supreme Court referred the matter to a Commissioner to take testimony regarding the parties' financial circumstances, and upon consideration of the record and a receipt showing Leonora had received $10,075 as full satisfaction of claims under an ante-nuptial agreement and prior alimony award, the Court deferred ruling on the petition.
The Court deferred ruling on the application for temporary alimony, suit money and counsel fees pending further proceedings at a later date, pending consideration of the full implications of Leonora's receipt and settlement.
“she has received, this 30th day of April, 1940, from William S. Burkhart and/or William S, Burkhart, Inc., an Ohio corporation, the sum of Ten Thousand Seventy Five ($10,075.00) Dollars as satisfaction in full of all claims and demands which she had against William S. Burkhart or William S. Burkhart, Inc., an Ohio corporation”
Establishes that Leonora received and acknowledged full settlement of prior claims under the ante-nuptial agreement and alimony award
